Customer Agreement

1. Introduction

This Customer Agreement (“Agreement”) is made between Mission Island Group, dba Milner Waste (“Company”) and The Signing Party (“Customer”) effective upon the signing of this document.

2. Services Provided

The Company agrees to provide bin collection services as follows:

Collection of customer specified waste upon request (subject to availability and fees).

Delivery and removal of bin style receptacle appropriate for the collection and removal of the waste outlined by the customer.

Disposal of the customer specified material at the appropriate disposal site at the agreed upon rate listed below.

3. Payment Terms

Payment Method: Credit Card

Deposit: $1000

Fuel Surcharge: Market rate fuel surcharges apply.

Environmental Surcharge: 2%

Payment Schedule: Payments due upon receipt of invoice.

Late Fees: A fee of 2% per week (104% per annum) will apply if payment is not received 30 days from receipt of invoice.

By completing this form, you the card holder authorizes Mission Island Group, dba Milner Waste to store your credit card information, to be charged when a deposit is required, and/or products and/or services are provided. A receipt for each payment will be provided to you and the charge will appear on your credit statement. You agree that no prior notification will be required to process any outstanding balance owed to Mission Island Group, dba Milner Waste.

4. Term and Termination

This Agreement shall commence on the agreed upon date of delivery for the waste receptacle and continue for a term of three (3) days.

A daily bin rental fee of $9.00+tax for regular bins and $10.00+tax for bins with lids shall be applied for every day thereafter.

5. Responsibilities of the Customer

The Customer agrees to:

Place only the material outlined and specified by the customer into the bin and agree to pay additional incurred costs for disposal if there is a variance due to mischaracterization of the material being removed.

Follow local and provincial guidelines for the responsible disposal of waste materials using company assets for the collection and transportation of materials to an end disposal site.

In the event there are additional fees imposed by the end disposal site the customer agrees to compensate the company for any fees incurred in full.

Pay any additional charges, fees, cleanup costs and lost income from associated operational shut downs if there are any associated to the disposal of undisclosed banned materials including: asbestos, drywall, metal, cardboard, wood, or any other banned items.

Adhere to weight restrictions provided by the company and take full responsibility for the loading of materials not to exceed outlined weight restrictions.

Pay any additional charges, fees, or third party costs associated with unloading bins that have been loaded to exceed the maximum weight restrictions.

Ensure all materials fit securely inside the bin and do no exceed the height of the bin itself, or hang outside of the bin.

Notify the company immediately if the equipment is damaged causing it to be unsafe. The customer agrees to discontinue using the equipment until it can be replaced with safely operating equipment.

Ensure that bins are accessible for collection at scheduled time and place.

Accept the addition of an hourly “Truck Rate” applied to the final invoice for all scheduled services not able to be completed due to customer oversight, unpreparedness or lack of communication.

Customer agrees to pay for any damages to or loss of the bin, as an insurer, regardless of cause, except reasonable wear and tear, while the bin is in possession of the customer.

6. Confidentiality

Both parties agree to keep confidential information private and not disclose it to any third parties without prior written consent.

7. Limitation of Liability

· The Company shall not be liable for any indirect, incidental, or consequential damages arising from service interruptions or collection delays.

· The Company shall not be liable for any damages to a place or property that come as a result of assets and/or equipment requested by the customer to a designated service location.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of British Columbia, Canada and any applicable municipalities.

9. Amendments

Any amendments to this Agreement must be made in writing and signed by both parties.

10. Acceptance

By checking the box and signing, the Customer acknowledges that they have read, understood, and agreed to all terms outlined in this Agreement.
